This website is owned and operated by ANCIENT LANKA TOURS & TRAVELS (PRIVATE) LIMITED, a company duly incorporated under the company laws of Sri Lanka, having its registered office at No. 530/8, 12th Lane, Daminnagahawatta, Kimbulapitiya in the Democratic Socialist Republic of Sri Lanka (hereinafter, as and when the context so requires, called and referred to as “Ancient Lanka Tours”). By accessing and using this website, you agree to be bound by the terms and conditions of use, set out herein below. The attached terms of online reservations (hotel bookings, transport, vehicle hire, transfers & excursions) will apply when you make your reservations online and shall form part and parcel of this agreement. The principals of data protection of ANCIENT LANKA TOURS are also annexed hereto for your reference.

 

Terms & Conditions to Use

a) ACCEPTABLE USE

You (customer / agent) may use this website in accordance with these terms and conditions for lawful and proper purposes complying with all applicable laws, regulations and codes of practice in Sri Lanka or other jurisdictions from which you are accessing the website.

In particular, you (customer / agent) agree you (customer / agent) shall not post, transmit or disseminate any information via this website which is or may be harmful, obscene or otherwise illegal.

You (customer / agent) also agree not to:

Use this website in a manner which causes or may cause an infringement of the rights of another.

Use any software, routine, procedure or device to interfere or attempt to interfere with the operation or functionality of this website including but not limited to making available corrupt data, viruses via whatever means or interfere with its availability to others.

Deface, alter or interfere with the look and feel of this website or underlying software code.

Take any action that imposes an unreasonable or disproportionately large load on the website or related infrastructure.

Obtain or attempt to obtain unauthorized access by whatsoever means to any of our networks.

Where Ancient Lanka Tours believe in its absolute discretion that you (customer / agent) are in breach of any of these terms and conditions, without prejudice to any of our rights at law or otherwise, we reserve the right to deny you (customer / agent) access to this website.

b) COPYRIGHT AND RESTRICTIONS ON USE

All trademarks, service marks, copyright, database rights, and other intellectual property rights in materials on this website, as well as the organization and layout of this website together with the underlying software, belong to Ancient Lanka Tours or its licensors.

The trademark, service mark and logos of Ancient Lanka Tours and its licensors must not be used, modified or adapted in any way without the prior written authorization of Ancient Lanka Tours.

The material on this website and the underlying software codes may not be copied, modified, altered, published, broadcast, distributed, linked to another website, sold or transferred whole or in part without an express written permission of Ancient Lanka Tours. Copying of any part for commercial or business use strictly prohibited.

This website has been compiled in good faith by Ancient Lanka Tours. No representation is made, or warranty given, either express or implied as to the completeness or accuracy of the information that it contains, that it will be uninterrupted or error free or that any information is free of bugs, viruses, worms, Trojan horses or other harmful components.

To the maximum extent permitted by law, Ancient Lanka Tours disclaims all implied warranties with regard to information, products, services and material provided through this website. All such information, products, services and materials are provided “as is” and “as available” without warranty of any kind.

This website may contain links to a website operated by third parties. Such links are provided for your reference only and your use of these sites may be subject to terms and conditions posted on them. Ancient Lanka Tours’ inclusion of links to other websites does not imply any endorsement of the material on such websites and Ancient Lanka Tours accepts no liability for their contents.

By accessing this website you agree that Ancient Lanka Tours shall not be liable for any direct, indirect or consequential loss or damages of any nature arising from the use of this website; this includes information and material contained in it, from your access of other material on the internet via web links from this website, delay or inability to use this website or the availability and utility of the products and services.

You further agree to indemnify, hold Ancient Lanka Tours harmless from and covenant not to sue Ancient Lanka Tours for any claims, damages / loses based on using this website.

d) MODIFICATION OF TERMS

Ancient Lanka Tours may make improvements and / or changes in the products, services and prices described in this website at any time without prior notice. Changes are periodically made to the website. Ancient Lanka Tours may amend these terms by posting the amended terms on this website. Continued use of this website following such changes shall constitute your (customer / agent) acceptance of such changes.

​e) GOVERNING LAW

The laws of the Democratic Socialist Republic of Sri Lanka govern the use of this website and you irrevocably submit to the non-exclusive jurisdiction of the courts of Sri Lanka. Ancient Lanka Tours reserves the right to bring proceedings against you in the country of your residence.

Nature of Overseas Travel

​

Holidays offered by Ancient Lanka Tours can range from luxury itineraries to programs for the more budget-conscious. We will make every effort to ensure that our planning is meticulous. But amenities and infrastructure in Sri Lanka can at times be comparatively underdeveloped. Delays, moments of discomfort and risk can naturally occur in all travel. In the tropics, insects in rooms are common. Tourists booking any of our arrangements implicitly accept this as a fact of life. Clients are advised to take sensible precautions at all time, and before booking a holiday should take steps to familiarize themselves with up-to-date information.

 

Indemnification

You agree to defend and indemnify Ancient Lanka Tours, its affiliates, and/or their respective suppliers and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by: (i) you or on your behalf in excess of the liability described above; or (ii) by third parties as a result of (a) your breach of this agreement or the documents referenced herein, (b) your violation of any law or the rights of a third party, or (c) your use of this website.

Conditions

​

Optional excursions and additional services could be provided for which we will charge additionally.

Visits to wildlife parks will be at client’s own risk.

Safari vehicles (non-air-conditioned) available are very basic with basic insurance cover (not comprehensive as in the case of vehicles used for tours).

 

Booking Conditions

​

Customers are responsible for reading the suppliers terms and conditions including booking conditions which are available on request. You agree to abide by the terms or conditions of purchase imposed by any supplier with whom you elect to deal. You understand that any violation of any such suppliers conditions of purchase may result in cancellation of your reservations or purchases, in your being denied access to any hotels, in your forfeiting any monies paid for such reservations or purchases, and Ancient Lanka Tours debiting your account for any costs we incur as a result of such violation. You will be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your use of this website, and, without limitation, you will be responsible for all charges, fees, duties, taxes, and assessments arising out of transactions performed by others on your behalf, whether or not such uses were performed with your consent.

With respect to hotel reservations and trael arrangements made directly through this website, your reservation will become confirmed once you have sent an on-line confirmation and provided your credit card details and paid the 20% advance amount OR any required deposits and when we acknowledge receipt of your full payment OR deposit. In some cases an initial non-refundable deposit may be charged.

Booking Your Holiday

​

A booking is accepted only after we receive written confirmation from you along with full payment OR a non-refundable deposit of 20% of the value of the Travel Arrangements. (This may be waived solely at our discretion).

For Peak Season Bookings 50% advance payment of total value is required.

Full payment OR the payment of a deposit and your written confirmation will indicate an acceptance of these terms and conditions by you

Final Payment

The balance of payment due for Your Travel Arrangements, it must be paid at the beginning of the tour.

Methods of Payment

Payments for deposits and final monies for Travel Arrangements may be made either by;

1) Cash

2) Bank transfer

3) Credit card. (Visa and Master card)

If paid by bank transfer any charges arising outside Sri Lanka should be borne by the remitter.

Amendments and Cancellations

​

While We will use Our best endeavors to provide all Travel Arrangements as confirmed, reasonable changes in the Travel Arrangements may be made without notice to You if deemed necessary or advisable by Us at Our discretion.

Cancellation of Your Travel Arrangements by You must be notified to us in writing, and will take effect the day we receive it. The following Penalties will apply dependent upon the number of days before Your Travel Arrangements commence:

Advanced payment is not refundable in cancellation.

Cancellation on 15 or Less than 15 days - 50% of total travel arrangement cost

Cancellation on the arrival day or day before the arrival day - 100% of total ground arrangement cost

Our cancellation provisions also hereby override any conflicting cancellation provisions set out by any individual operators or suppliers used by us.

No refund is available to you for cancellations after commencement of Your Travel Arrangements or on any services not used for any reason.

Cancellation policies differ according to each boutique property. 100% non-refundable cancellation fee will be charged accordingly

Cancellation by Us

​

Ancient Lanka Tours is committed to the highest ethical and professional standards to ensure your tour is a smooth and happy experience. But, please be aware we might have to cancel your tour to avert certain risks and dangers that may arise due to incidence of Force Majeure beyond our control (see clause below). In such an event we will alternately offer a comparable booking for your consideration. We cannot be held liable for any incidental expenses that you may incur during arrangements for a booking that is subsequently cancelled by us.

Force Majeure

​

Due to the nature of some tours featured, changes may occur, without notice to the stated content or schedule of itineraries. Certain risks and dangers may arise beyond our control including, but not limited to war, terrorism, civil disturbance, pilferage, delays, severe weather, Acts of God, Acts of Government, accidents to or failure of machinery, equipment, vehicles, industrial disputes or local operational limitations beyond our control.

Ancient Lanka Tours reserves the right to cancel the whole or any part of a tour at any time as a whole or any part of a tour at any time as a result of force majeure or for reasons outside Ancient Lanka Torus’s control, including but not limited to the failure of any third-party to perform.

Ancient Lanka Tours shall not be liable for damages of any kind arising out of any failure or delay in performing any or all of our obligations contained herein or in respect of any product or service if the failure or delay is due to circumstances or cause beyond our reasonable control. Ancient Lanka Tours will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood you will take adequate travel insurance to cover any travel or medical eventualities.

Itinerary Changes Requested By You

​

Ancient Lanka Tours aims to offer tailor-made, flexible itineraries to your satisfaction. You acknowledge that it once an itinerary is finalized, requests for changes to a group or individual itinerary will always be considered. You further acknowledge that any changes may incur cancellation charges and you will be charged for any additional services provided to you.

Important Note    

​

There may be an unforeseen escalation in fuel prices, new taxes / levies on hotels and transportation services or hikes in entrance fees; any large tax hikes and new levies shall also be payable extra and shall be billed accordingly with reasonable prior notice.

If a customer makes a hotel reservation through Ancient Lanka Tours acting on behalf of the hotel and when the client cancels a reservation instead of contracting the hotel directly, he or she may contact Ancient Lanka Tours and receive a cancellation confirmation code. In this situation, the hotel cannot process “No – Show Transaction” when the client cancelled the reservation according to the Ancient Lanka Tours cancellation policy, and the client has the cancellation number. Failures in communication and Ancient Lanka Tours must be resolved by the two parties without involving the cardholder.

General Reminder

​

• The program is based on the availability of the hotel rooms at the time of forwarding the quotation. As such, rooms are subject to availability at the time of booking.

• Due to high occupancy / demand, the hotels accept only the confirmed bookings.

• Once our proposal is accepted, the final confirmation will be forwarded along with the relevant overnight stays and itinerary. We will do our best to book the mentioned hotels or alternate similar category hotels.

• In case of any price fluctuations due to change of hotels, we will send a revised quotation.

Currency Conversion Policy

​

Please note that neither Ancient Lanka Tours (Pvt.) Ltd. nor the owning company it represents on this website will be liable for any exchange rate losses / gain due to any transactions / refunds processed, irrespective of customer’s credit / debit card currency. If the price of Your Travel Arrangements is increased by any matters outside our control then you must either pay the additional price to us when we request it or cancel Your Travel Arrangements in accordance with these Booking Conditions.

All prices are provided in United States dollars. Payments can be done in all the four currencies, US$, Euro, GBP or LKR

Health, Passport and Visas

​

It is your responsibility to ensure that you and other members of your party obtain the right inoculations and medical advice before you travel. Similarly, it is your responsibility to ensure that you and other members of your party have correct and valid passports, visas and have conformed to all other requirements pertaining to your travel arrangements before the holiday commences. We will not be held responsible for you travelling without the correct travel documents.

Travel Insurance

​

You are strongly recommended to take out personal travel insurance, at the time of booking, for all members of your party. It is your responsibility to ensure that the insurance you purchase is adequate. Booking acceptance shall be deemed to include your confirmation that you have taken out such insurance. If required Ancient Lanka Tours can also provide your personal travel insurance for the time spent in the island, please contact us for further details.

Breakages and Damages

You will be responsible for any breakages, losses or damage caused by you or a member of your party during your stay in the accommodation or / and vehicle. It is your responsibility to put right the damage or to make full payment to the supplier before departure and to indemnify us against any losses, damages or claims made against us.

Arbitration

​

When your booking is confirmed with us, a contract between Ancient Lanka Tours and / or you is constituted. That contract and these Booking Terms and Conditions shall be governed in all respects by the laws of Sri Lanka.

​

Complaints

​

We would wish to resolve amicably any reasonable complaint that we receive relating to the standard of your travel or accommodation arrangements. However, you must try to resolve any complaint immediately that you have with the supplier of the service direct (i.e. the accommodation owner, airline or individual service provider) while also at the same time keeping the Ancient Lanka Tours representative and travel counselor who handled your booking informed of all such complaints as and when they arise.

If your complaint cannot be resolved locally you must follow this up by writing a formal complaint letter to us within 28 days of your return home incorporating all other relevant information. It is a condition of this agreement that you communicate any problem to the supplier of the service/s in question and inform the relevant Ancient Lanka Tours representative and travel counselor who handled your booking and if still not resolved then follow this up with a written complaint. If you fail to follow this simple procedure we cannot accept responsibility as we have been deprived of the opportunity to investigate and rectify the matter.

We are always looking for ways to improve our service and our products and as your feedback can help us to do this we will provide a Customer Survey for your completion.

Shopping

​

Ancient Lanka Tours Travels, under no circumstances, recommends or guarantees the value or the quality of any additional product not clearly itemized on the Travel itinerary which may be purchased during an itinerary arranged in part or whole by us, even in the case where the product may have been discussed between a client and an employee or representative of Ancient Lanka Tours. Determining the value of a product is entirely the client’s responsibility. Ancient Lanka Tours has no duty to intervene in such circumstances and cannot be held responsible for subsequent complaints. Ancient Lanka Tours does not endorse any shops nor do we have any association with their operators. Ancient Lanka Tours do not accept any responsibility for quality, value, reliability or authenticity of any goods that you may purchase while on tour, nor is Ancient Lanka Tours liable in any way whatsoever for any arrangement you may make to post, courier, and freight or ship such purchases.
